Fig Phones – TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) govern your purchase and use of devices and wireless services provided by Mulberry Tech Group LLC, doing business as Fig Phones (“FIG Phones,” “we,” “us,” or “our”). By purchasing, activating, using, or paying for any Fig Phones device or service, you agree to be bound by these Terms, our Privacy Policy, Acceptable Use Policy, Return & Exchange Policy, and your selected rate plan (collectively, the “Agreement”).

1. Eligibility and Acceptance
You must be at least 18 years old and legally authorized to enter into this Agreement. You accept these Terms by activating or using a Device or Service, authorizing payment, or otherwise indicating acceptance.

2. Devices and Services
Fig Phones provides wireless devices and services subject to network availability, coverage, compatibility, and technical limitations. Devices may receive software or configuration updates remotely, which may affect functionality.

3. Religious Compliance and Content Filtering
Fig Phones devices and services are intentionally designed to comply with kosher and religious standards as determined by Fig Phones in consultation with its rabbinical authorities and recognized filtering organizations.

Accordingly, Fig Phones reserves the right, in its sole discretion, to block, restrict, limit, disable, modify, or remove access to any content, service, feature, application, phone number, communication method, or functionality on any device.

This may include, without limitation: web or internet access, images, videos, messaging services, artificial intelligence services, AI-powered phone numbers, applications, data services, and any present or future technologies deemed inappropriate or non-compliant with kosher standards.

Filtering may be implemented through software, hardware, network-level controls, third-party filtering services, automated systems, or manual review. Filtering standards may evolve over time. You acknowledge that such filtering is a fundamental feature of Fig Phones services and waive any expectation of unrestricted access.

4. Acceptable Use
You agree to comply with our Acceptable Use Policy. Attempting to bypass, disable, or circumvent filtering or security controls is prohibited.

5. Privacy
Our Privacy Policy governs how information is collected, used, and shared. Certain features or services may be restricted pursuant to religious compliance standards.

6. Payments and Billing
You are responsible for all charges associated with your account, including service fees, taxes, and applicable surcharges, in accordance with your selected rate plan.

7. Service Changes, Suspension, or Termination
FIG Phones may modify, limit, suspend, or terminate services at any time as permitted by law, including for non-payment, misuse, policy enforcement, kosher compliance, or to protect our network.

8. Disclaimer of Warranties
Devices and services are provided “as is” and “as available,” without warranties of any kind, express or implied, to the fullest extent permitted by law.

9. Limitation of Liability
To the maximum extent permitted by law, Fig Phones shall not be liable for indirect, incidental, consequential, or punitive damages arising from use of devices or services.

10. Dispute Resolution and Arbitration
Most disputes must be resolved through binding arbitration on an individual basis. Class actions and jury trials are waived to the extent permitted by law.

11. Governing Law
This Agreement is governed by the laws of the State of Missouri, without regard to conflict of laws principles.

12. Entire Agreement
These Terms constitute the entire agreement between you and Fig Phones regarding devices and services, except as otherwise incorporated by reference.
